1. About Us

Traveling Ground is operated by Traveling Ground LLC, located at 1201 Santa Fe Drive, Suite D, Denver, CO 80204. For any questions about these Terms, contact us at contact@travelingground.com or 303-219-0168.

2. Overview of Services

In addition to selling new and certified pre-owned bicycles and related products online and in store, Traveling Ground operates a full-service bicycle repair shop at our Denver location. We perform bicycle service and repairs for customers, and we may store bikes for customers in connection with service, drop-off, pickup, trade-in, or related arrangements, subject to any separate terms, timelines, or fees communicated at the time of service.

Service turnaround times, pricing, and storage details are provided at booking or drop-off and may vary by the work required. Leaving a bicycle with us for service or storage constitutes acceptance of these Terms and any additional service terms we provide.

3. Eligibility

You must be at least 18 years old, or the age of majority in your state of residence, to place an order on the Site or enter into a service arrangement with us. By using the Site or our Services, you represent that you meet this requirement and that all information you provide to us is accurate and current.

4. Products: New and Certified Pre-Owned

4.1 New Products. New bicycles and accessories are sold subject to the applicable manufacturer's warranty, where one exists. Traveling Ground does not extend or modify manufacturer warranty terms unless explicitly stated in writing.

4.2 Certified Pre-Owned Products. Some Products are sold as "Certified Pre-Owned." This designation means the item has undergone our inspection and certification process as described on the relevant product page, and typically includes a condition grade, mileage/usage estimate, and a listing of any known cosmetic or mechanical notes. "Certified Pre-Owned" is a description of our inspection process — it is not a manufacturer warranty and does not imply the Product is new or free of all wear consistent with prior use.

4.3 Condition Grading & Specifications. Product listings include condition notes, specifications, and photos intended to accurately represent each item. Because certified pre-owned items are individually inspected, minor variations between written descriptions and the physical item's cosmetic condition may occur. We make reasonable efforts to disclose all known material defects prior to sale. If you discover an undisclosed material defect, contact us within 14 days of delivery so we can address it under our Return Policy (Section 8).

4.4 No Additional Warranty. Except as expressly stated on a product listing or required by applicable law, all Products are sold "AS IS" and "WHERE IS," without any additional warranties of merchantability, fitness for a particular purpose, or non-infringement.

5. Pricing, Availability, Orders & Offer Validity

All prices are listed in U.S. dollars and are subject to change without notice. Because certified pre-owned bicycles are unique, one-of-a-kind items, availability is not guaranteed until an order is confirmed. We reserve the right to refuse, cancel, or limit any order, including in cases of pricing errors, suspected fraud, or unavailability of inventory. If we cancel a confirmed order, we will issue a full refund of any amount charged.

Unless otherwise stated in writing, purchase offers, buy offers, trade-in offers, and sell offers issued by Traveling Ground are valid for 14 days from the date the offer is issued. After that period, the offer expires and may be revised or withdrawn based on current market conditions, item condition, or other factors.

6. Payment & Financing

6.1 Accepted Payment. We accept the payment methods displayed at checkout, which may include major credit/debit cards and Shop Pay.

6.2 Installment Financing. Where available, Shop Pay Installments (or similar third-party financing options) allow qualifying customers to pay over time. These financing arrangements are provided and underwritten by the applicable third-party financial partner (e.g., Affirm, Shop Pay's financing partners), not by Traveling Ground. Approval, interest rates, and repayment terms are determined solely by that third party and governed by its own terms and privacy policy. Traveling Ground is not a party to and bears no responsibility for the financing agreement between you and the third-party lender.

7. Shipping & Delivery

7.1 Shipping Fees. Shipping is offered at the flat rate displayed at checkout for the applicable region. Shipping fees are non-refundable except where a return is due to our error or a defective/misrepresented Product.

7.2 Insured Delivery. Shipments are insured against loss or damage in transit. If your Product arrives damaged, you must notify us within 14 days of delivery, with photos of the damage and packaging, so we can file a carrier claim and arrange a repair, replacement, or refund as appropriate.

7.3 Packaging & Assembly. Bicycles are professionally packed for shipment. Some assembly (e.g., handlebar, pedals, front wheel) may be required upon arrival. Instructions or assembly support details, if offered, will be provided on the relevant product page or order confirmation.

7.4 Risk of Loss. Risk of loss and title for Products pass to you upon our delivery to the carrier, except where a shipment is insured under Section 7.2, in which case we will work with you and the carrier to resolve in-transit loss or damage claims.

7.5 Delivery Timing. Estimated ship and delivery dates are provided in good faith but are not guaranteed. Traveling Ground is not liable for delays caused by the carrier or events outside our reasonable control.

8. Returns & Refunds

We offer a 14-day return period from the date of delivery, subject to the full terms, conditions, and any exclusions set out in our Return Policy. Our Return Policy is incorporated into these Terms by reference. In the event of any conflict between this Section 8 and the Return Policy page, the Return Policy page controls.

9. Trade-In & Sell Programs

If you participate in any trade-in, sell, or consignment program offered by Traveling Ground, that transaction is governed by the separate terms presented to you at the time of that offer, in addition to these Terms. Unless otherwise stated in writing, any offer we issue in connection with a trade-in or sell program is valid for 14 days from the date it is issued.

10. Accounts

If you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at contact@travelingground.com of any unauthorized use.

11. Intellectual Property

All content on the Site — including text, graphics, logos, photographs, and product descriptions — is owned by or licensed to Traveling Ground and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent.

12. Prohibited Conduct

You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to our systems; (c) interfere with the proper functioning of the Site; (d) submit false information in connection with an order, return, trade-in, or service; or (e) resell Products purchased from us in a manner that falsely implies an affiliation with or endorsement by Traveling Ground.

13. Limitation of Liability

To the fullest extent permitted by Colorado law, Traveling Ground's total liability arising out of or relating to your purchase of a Product, use of the Site, or use of our Services will not exceed the amount you paid for the Product or Service giving rise to the claim. Traveling Ground is not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or personal injury arising from use or misuse of a bicycle, except to the extent such limitation is prohibited by law. Nothing in these Terms limits liability for gross negligence, willful misconduct, or claims that cannot legally be limited.

14. Assumption of Risk

Cycling carries inherent risks, including risk of serious injury. You are responsible for ensuring any Product is properly assembled, fitted, and maintained before use, and for using appropriate safety equipment. Traveling Ground is not liable for injuries resulting from improper assembly, maintenance, modification, or use of a Product after delivery.

15. Dispute Resolution & Governing Law

15.1 Governing Law. These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles.

15.2 Informal Resolution First. Before filing a claim, you agree to contact us at contact@travelingground.com to attempt to resolve the dispute informally. Most concerns can be resolved this way.

15.3 Venue. Any dispute not resolved informally will be subject to the exclusive jurisdiction of the state or federal courts located in Denver County, Colorado, and you consent to personal jurisdiction there.

16. Mobile Messaging Terms (SMS & RCS)

The Traveling Ground mobile message service (the "Messaging Service") is operated by Traveling Ground LLC ("Traveling Ground," "we," or "us"). Your use of the Messaging Service constitutes your agreement to these mobile messaging terms. We may modify or cancel the Messaging Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these mobile messaging terms at any time, and your continued use of the Messaging Service following the effective date of any such changes constitutes your acceptance of those changes.

By consenting to Traveling Ground's SMS/text and/or RCS messaging service, you agree to receive recurring messages from and on behalf of Traveling Ground through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (for example, order updates, shipping notifications, and account alerts). Promotional messages may include promotions, specials, and other marketing offers (for example, cart reminders and sale announcements).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Traveling Ground. Your participation in this program is completely voluntary.

We do not charge for the Messaging Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text or RCS messages, including charges from your wireless provider.

You may opt out of the Messaging Service at any time. Text STOP to cancel. You may also click the unsubscribe link (where available) in any text message to cancel. You will receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Traveling Ground mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Messaging Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received, and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Messaging Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Messaging Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Messaging Service.

17. Changes to These Terms

We may update these Terms from time to time. The "Effective Date" above reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
